These Terms of Service ("Terms") govern your access to and use of the FalcoAlgo website (falcoalgo.com) and any products or services we offer ("Services"). By accessing or using our Services, you agree to be bound by these Terms.

Risk Disclosure: Automated trading involves substantial risk of loss and is not appropriate for all investors. Past performance of any trading strategy is not necessarily indicative of future results. You may lose all or more than your initial investment. Only trade with capital you can afford to lose entirely.

1. Acceptance of Terms

By accessing falcoalgo.com or purchasing a subscription, you agree to these Terms and our Privacy Policy. If you do not agree, do not use our Services.

2. Services Description

FalcoAlgo provides automated trading algorithm files for NinjaTrader 8, along with supporting educational and setup materials ("Strategies"). These are software products distributed as subscription licenses. FalcoAlgo does not provide investment advice, financial planning, or brokerage services.

3. Subscriptions and Payment

3.1 Subscription Plans

Strategies are available on monthly or annual subscription plans. Pricing is displayed on the applicable strategy page and the Plans page. By subscribing, you authorize FalcoAlgo (via Stripe) to charge your payment method on a recurring basis until you cancel.

3.2 Billing

Monthly subscriptions are billed every 30 days. Annual subscriptions are billed every 365 days. Payments are processed by Stripe. FalcoAlgo does not store payment card information.

3.3 Refund Policy

We offer a 30-day money-back guarantee from the date of your initial subscription payment. To request a refund, email support@falcoalgo.com within 30 days of your first payment. Refunds are processed within 5–10 business days. After 30 days, all payments are final except as required by applicable law.

3.4 Cancellation

You may cancel your subscription at any time through the Stripe billing portal or by contacting us. Cancellation takes effect at the end of the current billing period. No prorated refunds are issued for the remaining billing period unless within the 30-day guarantee window.

4. License and Intellectual Property

4.1 License Grant

Upon active subscription, FalcoAlgo grants you a personal, non-exclusive, non-transferable, revocable license to use the Strategy algorithm file solely for your own personal trading on a single NinjaTrader installation. This license is valid only while your subscription remains active.

4.2 Restrictions

You may not:

  • Share, resell, sublicense, or distribute the algorithm files to any third party
  • Reverse engineer, decompile, or attempt to extract the source code of any algorithm
  • Use the algorithm files on behalf of or for the benefit of any third party (including managed accounts) without written permission
  • Remove or alter any licensing, copyright, or proprietary notices

4.3 Ownership

All algorithms, content, and materials on the Site remain the exclusive intellectual property of FalcoAlgo. These Terms grant you a limited license, not ownership.

5. Risk Disclosure and Disclaimer

Trading futures and other financial instruments involves significant risk of loss. The performance data and win rates displayed on the Site are based on historical backtesting and live trading data. Past performance is NOT indicative of future results.

FalcoAlgo does not guarantee any specific trading results. The Strategies are tools — their performance in live markets depends on many factors outside our control, including your broker's execution quality, market conditions, your account size, and system uptime.

You acknowledge that you are solely responsible for any trading decisions made using FalcoAlgo Strategies and that you have read and understood this risk disclosure.

6. Not Investment Advice

FalcoAlgo is a software provider, not a registered investment advisor, broker-dealer, or commodity trading advisor. Nothing on this Site constitutes investment advice, financial advice, or a recommendation to buy or sell any financial instrument. Always consult with a qualified financial advisor before making investment decisions.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FALCOALGO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING TRADING LOSSES, LOSS OF PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICES OR STRATEGIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to indemnify and hold harmless FalcoAlgo and its affiliates from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

9. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date. Continued use of the Services after changes constitutes acceptance of the new Terms.

10. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your license to use the algorithm files is immediately revoked.

11. Governing Law

These Terms are governed by the laws of the state of . Any disputes shall be resolved in the courts of , and you consent to exclusive jurisdiction in those courts.
